1. Acceptance of Terms

By using ShiftCare's platform and SMS services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

ShiftCare provides an SMS-based shift management platform for licensed home care agencies. The service automates caregiver cancellation handling, coverage coordination, and family notifications via text message.

3. SMS Messaging Terms

By providing your mobile phone number and consenting to receive messages from ShiftCare, you agree to receive automated text messages including:

• Shift confirmations, cancellations, and coverage requests (caregivers)
• Caregiver arrival updates for scheduled visits (family contacts)
• Operational alerts and summaries (agency administrators)

Message frequency varies based on shift activity. Standard message and data rates may apply. Reply STOP at any time to opt out. Reply HELP for assistance.

Consent to receive SMS messages is not a condition of employment or service. Mobile information will not be sold or shared with third parties for promotional or marketing purposes.

4. User Responsibilities

Users of ShiftCare agree to:

• Provide accurate contact information
• Notify the agency of phone number changes promptly
• Use the platform only for its intended purpose of home care shift management
• Maintain confidentiality of login credentials

5. Agency Responsibilities

Agencies using ShiftCare agree to:

• Obtain proper written consent from caregivers and family contacts before enrolling them in SMS notifications
• Maintain records of consent in accordance with applicable law
• Comply with all applicable state and federal labor and privacy laws
• Notify ShiftCare promptly of any data incidents or compliance concerns

6. Limitation of Liability

ShiftCare is a coordination tool and does not guarantee shift coverage outcomes. We are not liable for missed or delayed shifts, caregiver availability, or any consequential damages arising from service use. Maximum liability is limited to fees paid in the prior 30 days.

7. Modifications

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms. Material changes will be communicated via email to registered agency accounts.

8. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes will be resolved in the courts of Alexandria, Virginia.
